Bayer-Global is very well known for all of the different types of products they have to aid in farming crop protection as well as consumer health. One problem that will be costing them billions of dollars in financial settlements to the victims of non-Hodgkin’s lymphoma, a form of lymphatic cancer. The settlement amount has an allocated $10.05, and $10.85 billion dollars in funds.
In late June of 2020, Bayer announced a settlement they had with about 95,000 of potentially 125,000 plaintiffs. These plaintiffs are alleging to have developed non-Hodgkin’s lymphoma due to the main ingredient in Roundup called glyphosate. This exposure to glyphosate typically has a mean cost for treatment of upwards of $85,934 for a course of six months to combat aggressive non-Hodgkin’s lymphoma. Interestingly enough, Bayer didn’t even invent Roundup. Roundup was originally a dangerous product of Monsanto which Bayer purchased in 2018. This buyout also gave them the legal problems Monsanto was experiencing at the time.
An estimation of the settlement allocation shows that all awards to plaintiffs will range from $5,000 to $250,000. The settlement funds if each plaintiff receives an equal distribution, would be around $100,000. In other words, the amount being set aside for the plaintiffs is hardly adequate enough to pay for the damages and treatments.
However, plaintiffs are seeing great successes on the litigation front for the first few cases going to trial. Monsanto and Bayer have lost all three cases in litigation in regards to Roundup. One case where a groundskeeper was awarded $289 million in 2018 having used Monsanto’s Roundup likely caused his cancer.
