Key Takeaways

  • Attorney Mahsa Kashkooly of Angel Reyes & Associates recovered $282,500 for a client injured by a driver who failed to yield while turning left.
  • One crash can involve several policies, including PIP and first-party coverage, and each has to be pursued separately to recover everything available.
  • An insurer’s first offer often tests your patience rather than your case; here the final recovery was nearly six times that opening number.

Angel Reyes & Associates Turns a Low Offer Into Every Available Dollar

Attorney Mahsa Kashkooly of Angel Reyes & Associates has recovered $282,500 for a client injured when a driver turned left across their path without yielding the right of way. Getting there was a complex path that involved collecting the full limits of three different insurance policies. What started from a highest pre-litigation offer of just over $47,000 ultimately ended up in a six-figure recovery.

Our client was traveling straight through an intersection when a driver coming from the opposite direction cut left in front of her to reach a side street. They did not yield the right-of-way, causing our client to strike the passenger side of their vehicle. The impact tore up the front and driver’s side of our client’s car, and the impact caused the other driver’s vehicle to also collide with a third car, resulting in further damage.

Every airbag in our client’s vehicle deployed.

Three Policies, Three Separate Arguments

Serious crashes, especially those involving a commercial vehicle, can sometimes involve more than one source of coverage. That sometimes means more resources are available, but it also means the journey can be significantly more complex because each coverage layer has to be pursued on its own terms.

The at-fault driver’s liability policy carried a maximum of $250,000. Our client also carried another $30,000 of UM/UIM coverage on their own policy, and they had an additional $2,500 in personal injury protection, a no-fault benefit built into Texas auto policies that pays medical expenses regardless of who caused the crash.

Attorney Kashkooly, working with pre-litigation paralegal Jorge Duarte and litigation paralegal Oneal Valenzuela, pursued all three coverage sources and recovered every one of them in full.

The first-party carrier was its own fight. Our client’s future care needs were significant, and we had to lay that out in detail before that carrier would tender its limits.

Showing Up in Person

The best offer we received before litigation was just $47,477.37, an amount far below what our clients losses were worth. To complicate matters further, the defendant lives thousands of miles away in Alaska, and the other side seemed to treat that distance as a reason to believe we would eventually tire out and take the number. So they simply refused to move.

But Attorney Kashkooly never did tire out, and instead showed how ready we were to take the fight directly to them. In the middle of a federal government shutdown, with the delays and TSA security lines that came with it, she braved the airport to travel to Houston, got a car, and drove to the carrier’s office herself.

This sent a loud-and-clear message that we were not backing down, and we would do whatever the case required. That could include forcing the insurer to bring the defendant back down from Alaska for trial in a Texas courtroom.

This bold demonstration of tenacity had an almost immediate impact, with offers increasing within hours. In the end, we secured the entire $282,500 worth of coverage available to our client.

Why We Chase Every Policy

Insurance companies run a quiet calculation on every claim: how long can we wait, and how much less will this person accept once they are worn down. At Angel Reyes & Associates, our job is to take that variable off the table. We build cases for trial, we pursue every policy that might apply, and we go wherever the case needs us to go.

Our client did not get an offer that was close enough. They got all of it.

If you were hurt in a crash and the insurance company is pushing a number that does not come close to covering your care, you have options. Contact Angel Reyes & Associates today for a free consultation. Our strategy includes looking at every policy that may apply to your case so we can explain what your claim is worth and fight to recover all of it.

Past results do not guarantee a similar outcome. Every case is unique and must be evaluated on its own facts and circumstances.
