Key Takeaways

  • Spark requires valid auto insurance, but that alone does not prove your crash is covered.
  • Review actual policies to distinguish auto coverage from occupational injury benefits.
  • Save your signed Spark contract, trip records, and each carrier's written position.

Spark requires drivers to carry valid auto insurance, but uploading an insurance card doesn’t prove the policy covers delivery work. Spark’s occupational accident insurance concerns certain driver injuries, not auto liability or vehicle damage.

After a Walmart Spark accident, coverage depends on the policies in effect, your signed Spark agreement, and what you were doing when the crash occurred.

Does Spark’s Insurance Requirement Cover a Driver’s Crash?

Not by itself. The Spark Driver FAQ requires proof of valid insurance for every vehicle you use. The document must show your name, the policy’s expiration date, and the vehicle information. Drivers must also accept the Spark Driver Contract and App Terms of Use.

The public Spark Driver App Terms, dated March 20, 2024, require drivers to maintain state-minimum auto liability coverage and any other insurance appropriate for the services they provide. Drivers must keep their proof of insurance current and report service-related accidents to their insurer and Walmart.

The terms state that Walmart will make occupational accident insurance available and direct claim questions to Driver Support. However, they do not include an auto policy schedule or define coverage during each stage of a delivery.

Your signed contract may differ from the public terms. An insurance card confirms that a policy exists, but it does not confirm that the insurer covers paid delivery work. Review your signed agreement and complete auto policy before determining which coverage applies.

Which Insurance Could Pay for Each Loss?

Injuries to another person, damage to your car, and your own injuries may fall under different coverages.

How Your Personal Auto Policy Treats Delivery Driving

The Texas Department of Insurance delivery guidance explains that some personal auto policies cover paid delivery while others exclude business use. Tell your insurer about your delivery work and ask whether your policy covers it.

Coverage can also vary while you are traveling to a pickup, returning from a delivery, or taking a personal detour. Review the full policy and endorsements rather than assuming you have or lack coverage because a delivery endorsement is missing.

What Each Type of Coverage Addresses

The TDI auto insurance guide explains the main coverage types. Liability coverage may pay for injuries or property damage you cause others. Collision coverage may pay for damage to your vehicle, subject to your deductible and policy terms.

PIP, medical payments coverage, or uninsured and underinsured motorist coverage may help with your injuries, depending on how the crash happened and which coverages you purchased. Each has its own requirements and limits.

Occupational accident insurance may provide certain injury benefits. It does not establish auto liability or vehicle-damage coverage. Request the applicable certificate to check the benefits, eligibility requirements, and enrollment terms.

Why Any Program Policy Needs Its Own Review

Examine any applicable program auto policy separately. Check the insured driver, vehicle, effective dates, covered activities, exclusions, and other-insurance clauses. A corporate insurance memorandum does not establish that an independent Spark driver is insured.

The reviewed public documents do not establish a payment sequence. Ask each potentially relevant carrier to explain its position in writing. If you were injured, review the insurance questions as part of your Texas car accident claim.

What Texas Law Says About Spark Delivery Coverage

Texas law regulates delivery network companies differently from passenger rideshare companies. House Bill 4215, effective September 1, 2025, expanded Occupations Code Chapter 2402 to address delivery network companies. It did not create insurance limits specific to Spark.

Occupations Code Chapter 2402 excludes a business that only delivers products it produces or stores on its premises from the definition of a delivery network company. Whether the chapter applies can therefore depend on the entity involved and the delivery activity. Its independent-contractor provisions also do not automatically resolve who may be liable for a crash.

TDLR’s application guidance directs transportation and delivery network companies to provide proof of coverage required by Insurance Code Chapter 1954. However, Chapter 1954 uses terms associated with passenger transportation, including drivers, riders, and prearranged rides.

These laws establish general regulatory requirements but do not identify the policy, coverage limits, or payment order for a particular Spark accident. Do not assume that passenger-rideshare coverage automatically applies. Obtain the policies in effect on the crash date and compare them with the entity involved, your trip status, and your signed agreement.

Which Spark Trip Details Should You Save After an Accident?

Preserve records showing what you were doing when the collision happened. App timestamps help carriers apply the policy terms, but a timestamp alone does not establish coverage.

Save the records that apply to your trip:

  • Available without an accepted offer: Spark Now status, other active delivery apps, and any pending return obligation.
  • Offer accepted or traveling to pickup or shopping: the offer, acceptance time, order identifier, START TRIP, store arrival, and shopping records.
  • Pickup, loading, or delivery underway: pickup scans, route, location, remaining stops, and order details.
  • Completed, canceled, or returning an order: completion or cancellation time, return instructions, and support messages.
  • Personal driving or a detour: your timeline, destination, and any remaining delivery obligation.

Save your available completed and canceled trip history and trip receipts from the Earnings tab. These help document the timeline without deciding coverage.

After an accident following START TRIP, Spark’s incident-reporting instructions tell drivers to contact emergency services or their insurer when appropriate and reach Driver Support from a safe location. Keep the order number and report any injury that occurred during the delivery. Following these steps documents the incident but does not establish when insurance coverage begins or ends.

How Can You Find the Contract and Policy That Apply?

Download the signed Spark contract that was in effect on the crash date. Spark’s General FAQs provide these instructions:

More (iOS) or Menu (Android) → Settings → Spark Driver Contract and App Terms of Use → select the current or past signed document → share icon → choose where to save or send it.

The public terms are not a substitute for the version you signed. After saving your contract, gather the applicable insurance documents:

1. Ask your personal insurer or agent for declarations, complete policy forms, endorsements, and exclusions effective on the collision date.

2. Ask Spark Driver Support for the applicable program insurance contact and actual auto policy or certificate, coverage schedule, and endorsements, if any. Separately request the occupational accident certificate and claim instructions. This request does not guarantee Support will supply every document.

3. Give each potentially relevant carrier your accurate trip timeline. Request its written coverage position, including the facts and policy provisions it relies on.

4. Compare insured status, vehicle, effective dates, covered activities, exclusions, and other-insurance clauses before drawing payment-order conclusions. Keep original trip records and correspondence with the policies.

Spark Driver Insurance FAQs

Can you sue a Spark driver who caused a car accident in Texas?

Yes. If a Spark driver negligently causes a collision, an injured person may pursue a personal injury claim against the driver. Whether Walmart or another company may also be liable depends on the circumstances and applicable Texas law.

What happens if a Spark driver causes an accident without enough insurance?

If the at-fault driver’s available liability coverage cannot fully compensate an injured person, the injured person may be able to seek additional compensation through their own underinsured motorist coverage. Other potentially responsible parties may also be considered based on the accident’s circumstances.

Can a Spark driver receive workers' compensation after a delivery accident?

Spark drivers classified as independent contractors generally are not covered by traditional employer-provided workers’ compensation. However, eligibility depends on the actual working relationship and whether applicable workers’ compensation coverage exists.

How long do you have to file a lawsuit after a Spark driver accident in Texas?

Under Texas Civil Practice and Remedies Code Section 16.003, you must file most personal injury lawsuits within two years of the accident. Certain exceptions may change this deadline, so determining the applicable filing period is important.

Can you recover lost delivery income after a Spark driver accident?

A Spark driver injured by another person’s negligence may seek compensation for lost earnings when the accident prevents them from working. Trip receipts, earnings statements, and tax records can help establish lost income due to the injury.
