Angel Reyes & Associates Recovers Seven Figures Each for Two Clients Injured in a Commercial Truck Crash
Angel Reyes & Associates attorneys Javier Gonzalez, Alex Ivanov, Ryan Browne, and Spencer Browne have secured a $4.5 million settlement for two clients who suffered traumatic brain injuries in a rear-end accident that occurred near Abilene. Our clients were traveling together in the left lane of the highway, one behind the wheel and one in the passenger seat.
A Distracted Driver and a Five Vehicle Pile-Up
At the time of the accident, the driver was speeding and looking at his phone, causing him to react to the change in traffic speed too late to avoid the collision. He tried to steer onto the left shoulder, but his vehicle clipped the rear passenger side of our clients’ car, flipping it over multiple times and carrying it forward into the vehicle ahead of them.
Five vehicles were involved by the time everything came to a stop. Both of our clients were taken to the hospital with symptoms of traumatic brain injury.
We Filed Suit Before Anyone Else Sent a Demand
The conventional path in a case like this is to send a demand letter, wait for a response, and file suit only once talks stall. We chose not to take that path, instead opting to file a lawsuit on our clients’ behalf almost immediately. By the time the other claimants in this crash were sending their pre-litigation demands, we had already taken the driver’s deposition, deposed the company’s corporate representative, and designated our experts.
In commercial vehicle cases, that head start is worth more than any argument made in a letter. In a multi-car pile-up, insurance limits can disappear quickly. With five vehicles involved in the wreck, there were at least four other parties, all of whom might have significant injuries of their own. $5 million might sound like a lot, but that can disappear in a hurry when multiple serious injury claims are involved.
On top of that, the other side refused to put an offer on the table before litigation. Pursuing a resolution before litigation could have dragged the case out and meant a smaller settlement for our clients, so we opted not to wait. That is what created the pressure that moved the matter forward quickly.
We sent a Stowers demand, a formal notice that an insurer who refuses to settle within its policy limits can be held responsible for whatever a jury awards above them. With depositions completed, experts designated, and court deadlines running, the carriers faced real exposure on a short clock.
The Value Was Never in the Billing Records
Our clients’ billed medical expenses came to less than $230,000 combined, and health insurance covered large portions of that. A case valued on paperwork alone would have settled for a small fraction of what these two were able to actually recover.
Attorney Gonzalez worked with three of our firm’s partners, alongside pre-litigation paralegal Juan Vergara, litigation paralegals Marvin Mencidor and Joy Aguilo, and verification specialist Lady Lyn Nepomuceno, to build the case around what brain injuries cost a person over a lifetime rather than what had already been invoiced. Treatment coordination and litigation ran side by side, and the team kept both on schedule.
The case settled at mediation for a combined $4.5 million, divided equally between our two clients at $2.25 million each, coming less than a year after the crash.
The Fight Was Never About Who Caused the Crash
The other side never seriously contested fault in this case. The other driver admitted to speeding, being distracted by their phone, and having an open container in their vehicle (though they pass their field sobriety test and were not arrested). They did contest what two people living with brain injuries would need for the rest of their lives, and no insurance company will answer that question realistically on its own. Getting to a real answer takes a medical record built while treatment is happening, experts who can speak to long-term care, and a credible willingness to put all of it in front of a jury.
That is how Angel Reyes & Associates approaches every case we take, whether fault is contested or conceded on day one. If you or someone in your family was injured by a commercial vehicle, you should not have to work out what your claim is worth on your own. Contact Angel Reyes & Associates today for a free consultation. We will listen to what happened, walk you through your options, and fight for everything you are owed.
Past results do not guarantee a similar outcome. Every case is unique and must be evaluated on its own facts and circumstances.
