The insurer said she deserved nothing, then made a last-minute offer. We took it to a jury, and the jury awarded more than triple that.

The insurer’s last offer was $20,000, and it argued our client wasn’t really hurt. We went to trial, and a jury awarded more than ten times that.

A Tarrant County jury returned a $231,486.99 verdict for our client, who was injured in a 2018 car wreck caused by an Allstate-insured driver. With pre-judgment interest and court costs, the judgment is expected to exceed $245,000. The verdict was returned on August 5, 2021, in the 67th District Court in Tarrant County. Our client, who testified through a Spanish-speaking translator, incurred $50,311.99 in past medical bills with many providers, including Texas Healthcare Neck and Back and Dr. Eli Hothern, MD, who both testified on his behalf.
The Allstate insured took the position that our client wasn’t injured as badly as he alleged and that, if he was hurt, he shouldn’t have received all the treatment he did. The defense challenged the past medical bills through live testimony from Neal Blauzvern, DO, Monte Horne, DC, and medical billing coder Karen Linsteadt. It argued that our client’s treatment, including two caudal injections in his back performed a year apart, was unreasonable and unnecessary, and that he should be awarded only his initial emergency room bills and a few minor visits at a reduced charge. At trial, the defense also disputed liability and argued its driver wasn’t at fault. Allstate’s last pre-trial offer was $20,000.
Our team sent three Stowers demands for the $50,000 Allstate policy limits, and all three were denied. With no reasonable offer on the table, the case went to trial, where our client’s treating providers testified on his behalf. The jury awarded $231,486.99, more than eleven times Allstate’s last pre-trial offer.
